General session: Double-dipping in the FCRA pond: Wed., Nov. 12 (9:00 – 9:40)

The FCRA, as unfortunately interpreted by several federal courts, allows plaintiffs to “double-dip” on their alleged damages by suing resellers. This double dipping presents a rocky road for NCRA members. Christopher J. Capurso from Troutman Pepper Locke and Webb McArthur, of HudsonCook will share an update on litigation trends facing resellers and offer strategies for resellers to combat these challenges

Helping us to understand these issues are Christi Lawson, Partner at Foley Lardner; Troy Kubes, Managing Director, Financial Services; and Webb McArthur, Partner, HudsonCook

Tenant screening companies and their customers walk on the ever-shifting sands of compliance from courts, legislatures, and federal agencies. Two well-regarded attorneys will lead this session: Jay Harris, Partner, HudsonCook; and Noah J. DiPasquale, Associate, Troutman Pepper Locke. Topics for disdussion:

  • Key recent state laws (e.g., disclosures, conditional offer, application fees, limits on criteria, record sealing) 
  • Key recent case law (e.g., accuracy/currency, reasonable reinvestigation) 
  • Latest CFPB/FTC activity

Tenant Track: Convo w/ supporters of screening limits 11:40

Justice Ruth Bader Ginsburg said that people should disagree without being disagreeable. Tenant screening companies and their customers are passionate about their respective positions on policy issues over limiting the use of credit, criminal, and eviction histories. This panel will engage in a civil dialogue, and not a debate, about how tenant advocates, tenant screening companies, and housing providers can better understand each other’s positions and perhaps work together for the greater good. Our panelists will discuss the challenges they see impacting their constituencies and how providers and screeners can ensure that housing opportunities are equitable. 

 The panel of diverse interests will be moderated by Maitri Johnson, Senior Vice President, Tenant & Employment, TransUnion. On the panel are Rep. Jordan Teuscher (R-South Jordan); Zoë Newmann, Project Manager, Utah Housing Coalition.

Invited: Dave Todd, an attorney at Titan Legal; and Sen. Stephanie Pitcher (D-Salt Lake City).

Mortgage reporting track: AI in mort. lending, 11:40

Mortgage lenders are embracing AI. Artificial intelligence models, including GenAI, have multiple use cases impacting key operational components and offer a path towards more efficient and faster processes. Our panel will discuss how AI is being used and might be deployed going forward.  

 

Leading this discussion will be our moderator, Shawn Jobe, Vice President of Product and Software Development at Credit Interlink. Joining Shawn will be Christi Lawson, Foley Lardner; Upavan Gupta, Head of Data & Analytics, Housing & Verification, Experian; and Tanya Brennan, CEO, PhoenixTeam.

gen. Session: Cyber-security is like being an ultra-marathoner, 3:30

Zach Tisher is the CISO with Equifax’s U.S. Information Services (USIS). He is also an ultramarathoner. Both roles demand adaptability, mental fortitude, and endurance, but the real key is knowing what works, keeping it simple, and executing consistently. In this session, Zach will share how organizations of all sizes can strengthen their security by focusing on fundamentals and driving results tied to what matters most. The same mindset that gets runners to the finish line can help any business navigate today’s cybersecurity challenges with confidence and protect the trust of their customers.

General session: An econ. outlook for housing: rental & buying, 9:30

Predicting the future now is harder than ever, especially around the home buying and home rental markets. David Fay, Solutions Consultant for Experian works with mortgage lenders and other financial institutions to optimize their businesses by configuring and deploying data, analytics and machine learning, and software. David will help us understand the economic climate for mortgage reporting and tenant screening business in the context of the broader marketplace.  

At Experian, areas of expertise include credit lending, customer targeting & segmentation, digital technology, market trends, models and scores, partner solutions, and mortgage trends. 

Gen. Session: CFPB Complaints: good, bad, and the ugly, 10:20

CFPB complaints can help deepen customer relationships, prioritize complaints, create a more robust complaint process, and drive operating efficiencies. They can also offer an early warning signal to litigation. Despite their ability to improve business and compliance, CFPB complaints have a lot of noise. Finding the signals in the noise is critical, and our speakers will help NCRA members better leverage Bureau complaints for business success. 

Our panelists will be one of the founding employees of the CFPB, Jim McCarthy of McCarthy Hatch; and a leading consultant on CFPB complaints, Mei Guan, Partner at Oliver Wyman. Moderating the panel will be Christi Lawson of Foley Lardner. 

Mortgage Track: Mitigating Fraud in the Mortgage Industry, 11:15

Mortgage fraud is big business. CoreLogic found an 8.3% increase in fraudulent mortgage applications year-over-year in 2024. And fraudulent applications are only one slice of the fraud pie. 

We have three panelists to help understand how they view and combat mortgage fraud: Sherri Engberg, Principal, Global Fraud Solutions, TransUnion; Pam Lahr, Senior Vice President of Sales, PitchPoint; and Patrick Smith, Senior Vice President of Fraud Operations, American Bankers Association.

Tenant Track: Who Do You Think You Are? Mitigating Tenant Screening Risk, 11:15

Fraud in the rental process continues to rise. The fakes and fraudsters continue to up their deceitful games. Tenant screening companies and their housing provider customers are locked in an ever-evolving game of cat and mouse.  

Our panel will offer insights into the myriad solutions available to spot and remediate tenant screening fraud. We will have four panelists: Dave Todd, of the Titan Legal Group, who represents some of the largest landlords and PMCs in Utah; Lloyd Laudorn, Senior Solutions Engineer, Decision Analytics Fraud and Identity, Experian; Bill Hall, President and COO, Point Predictive; and Jason Kratovil, Head of Public and External Affairs, SentiLink.
